Food Allergens & Dietary Notice

All of our food is 100% plant-based. Our kitchen and truck handle ingredients including, but not limited to, wheat (gluten), soy, tree nuts, peanuts, sesame, and coconut. While we take care in preparation, cross-contact can occur and we cannot guarantee any item is free from a specific allergen.

If you have a food allergy, sensitivity, or specific dietary requirement, please let us know before ordering. You are responsible for evaluating whether our menu items are suitable for you, your guests, or anyone you order for.

Menu, Pricing & Availability

Menu items, pricing, hours, and locations shown on this site are subject to change without notice. We do our best to keep this information current, but errors can occur and items may sell out. The menu and pricing in effect at the time and place of your order are what apply.

Online Orders

Online ordering is handled by Toast, Inc. and is governed by Toast’s terms and policies in addition to ours. Order confirmation, modification, refunds, and payment processing flow through Toast. Pickup windows are estimates; we’ll do our best to have your order ready on time.

Catering & Events

Catering inquiries submitted through this site are requests, not confirmed bookings. A booking is confirmed only when we send you a written quote or contract and you accept it (and any deposit is received). Specific cancellation, rescheduling, deposit, and service terms will be set out in that quote or contract.

Intellectual Property

The Tabay's Mindful Kitchen name, logo, brand elements, website content, photography, recipes, and menu names are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, or use them for commercial purposes without our written permission.

Third-Party Links

Our site links to third-party services (such as Toast for ordering, Google Maps for directions, and our social media profiles). We are not responsible for the content, policies, or practices of those third parties. Your use of those services is at your own risk and subject to their terms.

Disclaimers

The website and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Tabay's Mindful Kitchen and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or our services. Our total liability for any claim related to your use of the site will not exceed one hundred U.S. dollars ($100). Nothing in these terms limits liability that cannot be limited by law.

Governing Law

These terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Gallatin County, Montana, and you consent to their jurisdiction.

Changes

We may update these terms from time to time. The “Effective” date at the top reflects the most recent version. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
